1. Privacy Policy & Data Security

Legal Entity: Harmony Women’s Health and Wellness Nursing Corporation

Information Collection & Secure Handling

We collect personal identification (name, DOB, contact info) and protected health information (PHI) through secure channels.

  • OptiMantra: We utilize OptiMantra as our Electronic Health Record (EHR) and patient portal. Data submitted via our scheduling links or patient portal is encrypted and HIPAA-compliant.

  • Spruce Health: All digital communication (text, secure messaging, and telecommunication) is conducted via Spruce Health, a HIPAA-compliant platform.

  • Standard Email/SMS: Please be aware that standard email and SMS are not inherently secure. By initiating contact through these non-secure channels, you acknowledge the privacy risks. We encourage all patients to use the Spruce app for secure communication.

  • Retention & Disposal: In accordance with California law, adult patient records are retained for a minimum of seven (7) years from the date of the last visit. Records for minors are retained until the patient reaches age 28. Upon the expiration of this period, electronic records are purged using secure, military-grade deletion protocols, and any physical media is professionally shredded.

California Privacy Rights (CCPA/CPRA)

Under the California Consumer Privacy Act, residents have the right to request access to, correction of, or deletion of their personal data. Requests can be directed to admin@harmonywellnessnp.com.

Your Rights

You have the right to inspect and copy your PHI, request an amendment to your records, and receive an accounting of disclosures we have made.

Permitted Disclosures

We may disclose PHI without your written authorization in specific instances required by law, including:

  • Public health activities (e.g., infectious disease reporting).

  • Judicial or administrative proceedings (e.g., valid subpoenas).

  • To avert a serious threat to health or safety.

Complaints

If you believe your privacy rights have been violated, you may file an internal grievance by contacting admin@harmonywellnessnp.com. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights (OCR). We will not retaliate against you for filing a complaint.

3. Terms of Service

No Provider-Patient Relationship

Use of this website or the Spruce/OptiMantra platforms for "discovery calls" or inquiries does not constitute a provider-patient relationship. Such a relationship is only established upon completion of a clinical intake and the signing of a Treatment Agreement.

Technical Limitation of Liability

We strive for 100% website and portal availability; however, we are not liable for:

  • Any damages resulting from website downtime or server errors.

  • Inaccuracies in educational content.

  • The failure of third-party platforms (OptiMantra/Spruce) beyond our direct control.

Intellectual Property

All content, including logos and educational text, is the property of Harmony Women’s Health and Wellness Nursing Corporation and is protected by California copyright laws.

The content on this website is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

EMERGENCY NOTICE: If you are experiencing a medical emergency, please call 911 or go to the nearest emergency room. This website and our secure messaging apps are not monitored 24/7 for emergencies.

5. Telehealth Informed Consent

In accordance with California Business and Professions Code § 2290.5, you must provide informed consent before receiving telehealth services.

  • Platform: We use Spruce Health for secure video visits.

  • Risks: While we use high-level encryption, potential risks include technical failures or interruptions.

  • Right to Withdraw: You have the right to withhold or withdraw consent to telehealth at any time without affecting your right to future care or treatment.

  • Licensing: Our providers are licensed to practice in the State of California. Telehealth services are only available to patients physically located in California at the time of the visit.

  • Recording & Prescribing:

    • No Recording: Recording of telehealth sessions by any party is strictly prohibited without prior written consent from both the provider and the patient.

    • Prescribing: Telehealth-based prescribing is at the sole discretion of the provider. Controlled substances are subject to federal DEA and California CURES regulations.

6. Financial Policies & Good Faith Estimate

Cash-Pay Practice

Harmony Women’s Health and Wellness N.C. is a "cash-pay" practice and does not contract with insurance companies. Payment is due at the time of service via our secure processor.

Good Faith Estimate (No Surprises Act)

Under the law, healthcare providers must give patients who don’t have insurance or who are not using insurance an estimate of the bill for medical items and services.

  • You have the right to receive a Good Faith Estimate (GFE) for the total expected cost of any non-emergency items or services.

  • You can ask for a GFE before you schedule an item or service.

  • For questions or more information about your right to a Good Faith Estimate, visit www.cms.gov/nosurprises.

Patient Responsibilities

Patients are expected to provide accurate health histories and respect the practice's 24-hour cancellation policy.

8. Treatment of Minors Policy

In accordance with the California Family Code, minors aged 12 and older may, in specific circumstances (such as reproductive health or mental health services), consent to their own outpatient treatment. For all other services, a parent or legal guardian must provide written consent for treatment and is responsible for all financial obligations.
